Terms of Service

These Terms of Service (“Terms”) govern your use of Rubric Maker (the “Service”), operated by Minh Phan as a sole trader based in Australia. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
Rubric Maker lets you create, edit, and export grading rubrics. Some features are free; others (“Pro”) require a paid subscription.
Your account
You are responsible for your account and for keeping your login secure. You agree to provide accurate information and to be responsible for activity that occurs under your account.
Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or to upload unlawful, harmful, or infringing content;
- attempt to disrupt, reverse-engineer, scrape, or gain unauthorised access to the Service;
- resell or redistribute the Service without our permission; or
- misuse the Service in a way that harms other users or us.
Your content
You retain ownership of the rubrics and content you create. You grant us a limited licence to store, process, and display that content solely to provide the Service to you. You are responsible for the content you enter and confirm you have the right to use it.
AI-generated content
The AI generation feature produces rubrics using an automated system. AI output is provided “as is”, may be inaccurate or incomplete, and must be reviewed by you before use. We make no guarantee as to the accuracy, quality, or suitability of AI-generated content, and you are responsible for how you use it.
Subscriptions, billing, and cancellation
- Pro subscriptions are billed in advance through our payment provider (Stripe, via Clerk);
- subscriptions renew automatically until cancelled;
- you may cancel at any time, and your Pro access continues until the end of the current billing period;
- except where required by law (including the Australian Consumer Law), payments are non-refundable;
- we may change pricing, with notice, effective from your next billing period.
Intellectual property
The Service itself — including its software, design, and branding — belongs to us. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any of our intellectual property to you.
Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude all warranties and do not guarantee that the Service will be uninterrupted, error-free, or secure.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for any loss of data, profits, or goodwill, arising from your use of the Service.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or misuse the Service.
Governing law
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
